Terms of Service

Who provides the service

RecheBot is provided by Luis Reche, a natural person resident in Spain, tax ID (NIF) [NIF pendiente], address [Domicilio pendiente]. Contact: rechedev@hotmail.com. Full details are in the Legal notice.

Acceptance and documents that form part of these terms

You accept these terms:

• as an administrator, when you add RecheBot to a Discord server or configure it; at that moment you also accept, on behalf of the server, the Data Processing Agreement;
• as a user, when you use any RecheBot command, button or page, for example when you enter a giveaway or link your Steam account.

The Privacy Policy and the Data Processing Agreement form part of these terms. If you do not agree, do not use the service and, if you are an administrator, remove the bot from your server.

Description of the service

RecheBot offers Discord servers:

• giveaways with a verifiable outcome (seed commitment, reveal and a public transparency page);
• configurable entry requirements: role, time in the server, verified Steam account, one entry per Steam account and minimum Steam account age;
• Steam account verification through the official Sign in through Steam (OpenID) and storage of the Steam Trade URL;
• community and moderation tools: anti-scam guard, server template (/setup), levels and leaderboard, vouches and reputation, scammer flags, middleman helper, scheduled announcements and role panels.

The service is free. There are no paid plans, in-service purchases, coins, extra tickets or paid entries. RecheBot sells nothing to participants.

Minimum age

You must be at least 14 years old to use RecheBot (Article 7 of Spanish Organic Law 3/2018, LOPDGDD) and, in any case, meet the minimum age Discord requires in your country.

You must be at least 18 years old to receive a prize. The giveaway organizer must check this before delivering the prize and may exclude anyone who cannot prove it.

The giveaway organizer

Each giveaway is organized by the server where it is published, represented by its administrators (usually the streamer or the community team). RecheBot is only the technical draw tool and is not the organizer.

The organizer is solely responsible for:

• writing, publishing and complying with the giveaway rules (the rules template can help);
• choosing the prize, describing it truthfully and having the right to give it away;
• delivering the prize by hand, through a Steam trade offer, within the time set in the rules;
• checking that the winner is of age and meets any other requirement in the rules;
• meeting its tax obligations and any other rules applicable to the giveaway (for example, gambling or advertising rules, where relevant);
• handling participants' complaints about the prize and its delivery.

RecheBot never owns, holds or sends skins or any other items. It has no Steam trading accounts, does not automate trade offers and never asks for passwords or Steam Guard codes. Prizes are expected to be of moderate value (for example, under 100 euros).

How a giveaway is decided

When a giveaway is created, RecheBot generates a seed with a cryptographically secure random number generator and publishes its SHA-256 hash. At close, it checks the requirements again, reveals the seed and draws the winners from it and the eligible entries, with no human involvement in the choice. The detailed process is in the giveaway documentation.

Requirement checks are automatic and apply exactly the configuration chosen by the organizer. If you think you were left out by mistake, tell the organizer, who can review it. If the organizer redraws a prize (for example, because the winner does not meet the requirements or does not reply within the time set in the rules), the new draw uses the same mechanism and is recorded.

Entering a giveaway means your Discord ID appears on that giveaway's public transparency page, as explained in the Privacy Policy.

Acceptable use

You may not use RecheBot to:

• run giveaways with paid entry, or require a purchase, donation, paid subscription or any other financial consideration to enter;
• sell, resell or transfer entries, or grant extra entries in exchange for money or items of value;
• link giveaways to betting, skin casinos, cases or any other gambling;
• give away items you do not own, cannot deliver, or whose delivery would breach Steam's terms;
• enter with multiple accounts, use bots or otherwise get around a giveaway's requirements;
• spread phishing or malware links, impersonate other people or staff, or harass other users;
• flag someone as a scammer, or write vouches or comments, with false, defamatory or unnecessary information;
• collect other users' data for purposes unrelated to the service, or attempt unauthorised access to RecheBot's systems or data;
• any use contrary to the law, to Discord's Terms of Service, Community Guidelines and Developer Policy, or to the Steam Subscriber Agreement.

Moderation features

The anti-scam guard, scammer flags, vouches and announcements are enabled and used by each server's staff, who are responsible for how they are used. In particular:

• the anti-scam guard is off by default; if the server turns it on, it may delete messages with dangerous links or temporarily time out their author, depending on the chosen configuration;
• scammer flags belong to each server, are never shared with other servers, and their reason is visible to staff only;
• if a flag or an automatic action affects you, you can ask the server staff to review it. If they do not respond, write to rechedev@hotmail.com: we can pass the request to the server and remove manifestly unlawful content once we have actual knowledge of it (Article 16 of the LSSI-CE).

Intellectual property

RecheBot's software, brand and texts belong to Luis Reche. You are granted a personal, free, non-exclusive, non-transferable and revocable right to use RecheBot through Discord under these terms.

You keep the rights to the text you enter (for example, vouch comments or announcements) and authorise RecheBot to store and display it in your server solely to provide the service.

RecheBot is not affiliated with, sponsored or endorsed by Valve Corporation or Discord Inc. Counter-Strike 2, CS2 and Steam are trademarks of Valve Corporation.

Free service and availability

RecheBot is offered free of charge and "as is". No minimum availability or error-free operation is guaranteed, and the service depends on Discord and Steam, which may suffer outages. Features may change or be withdrawn. If the service is to be shut down, notice will be given on this site at least 30 days in advance whenever possible, so servers can close their running giveaways.

Liability

To the extent permitted by law, Luis Reche is not liable for:

• the existence, value, quality or delivery of prizes, or the organizer's actions;
• trades between users, even if vouches, profiles or the middleman helper were used;
• outages, changes or decisions by Discord or Steam;
• indirect damages, such as loss of profit or loss of opportunity.

Nothing above limits liability for wilful misconduct or gross negligence, for personal injury, or the rights you have as a consumer under the Spanish consolidated General Law for the Defence of Consumers and Users (Royal Legislative Decree 1/2007) or any other mandatory rule.

Suspension

If these terms are breached, a user may be blocked from using RecheBot, a giveaway that breaches acceptable use may be cancelled, or the bot may be removed from a server. Whenever possible, and where it does not harm third parties or an investigation, the person affected will be notified first and given a chance to explain by email.

You can stop using RecheBot at any time. Administrators can remove the bot from their server at any time; what then happens to the data is explained in the Privacy Policy.

Data protection

Processing of personal data is described in the Privacy Policy. For each server's data, the server is the controller and Luis Reche acts as processor under the Data Processing Agreement.

Changes to these terms

These terms may be updated to reflect changes to the service or the law. The current version is always published on this page with its date. Significant changes will be announced on this site at least 15 days in advance. If you keep using RecheBot after they take effect, you will be deemed to accept them; if you disagree, you can stop using it and delete your data.

Governing law and jurisdiction

These terms are governed by Spanish law. If you are a consumer, you may go to the courts of your place of residence and you keep the protection granted by the mandatory rules of the EU country where you live. Before going to court, we encourage you to write to rechedev@hotmail.com to try to resolve any problem.

Language

These terms are published in Spanish and English. In case of discrepancy, the Spanish version prevails.
